Action taken by the Trial Court: The county court denied Flodman’s motion to suppress evidence obtained in an investigative stop. The parties agreed to a stipulated trial but reserved the issue of the validity of the stop of Flodman’s vehicle. The county court accepted the stipulation, found Flodman guilty, sentenced him to a term of 9 months’ probation, and revoked his driver’s license for 60 days. Flodman appealed to the district court, which affirmed the county court’s denial of the motion to suppress and affirmed Flodman’s conviction and sentence. Flodman then appealed to the Nebraska Court of Appeals.
Assignments of Error on Appeal: Did the district court err in affirming the county court’s determination that the stop of Flodman’s vehicle was not in violation of the 4th and 14th Amendments to the United State Constitution and the decision in Terry v. Ohio, 392 U.S. 1, 88 S. Ct. 1868, 20 L. Ed. 2d 889 (1968) and its progeny.
