Action Taken by Trial Court: Following a trial to the bench, the district court found the appellant guilty of intentional child abuse resulting in serious bodily injury. Thereafter, the court sentenced the appellant to 10 to 20 years’ imprisonment with credit for 263 days served.
Assignments of Error on Appeal: The appellant contends that the district court erred in sustaining the State’s objection to Kara Payne’s testimony as to Sergeant Novotny’s Statements; in not allowing the appellant to complete an offer of proof; and in admitting exhibit 25 into evidence. Appellant also contends that the evidence was insufficient to support his conviction and the sentence imposed was excessive.
