Criminal Action: First Degree Sexual Assault of a Child; First Degree Sexual Assault of a Child Under 12 Years of Age; Third Degree Sexual Assault of a Child
Action Taken by Trial Court: The district court, after a jury trial, convicted Haley of the above offenses. Haley was sentenced to a mandatory minimum of 15 years nor more than 20 years' imprisonment on Counts 1 and 2, said terms to be served concurrently. Haley was sentenced to 5 to 5 years' imprisonment on Count 3, to be served consecutively to Counts 1 and 2.
Assignment of Error on Appeal: Haley assigns: (1) the trial court committed plain error when it labeled the Project Harmony forensic interview video as substantive evidence and gave the jury unfettered access to it during deliberation; (2) he received ineffective assistance of counsel at trial; (3) the trial court erred in allowing April Anderson to give improper opinion testimony bolstering A.H.'s credibility and his trial counsel was ineffective for eliciting such testimony; and (4) there was insufficient evidence as to all counts.
