A-24-815, State v. Jeremiah T. (Appellant)
Douglas County, District Court, Judge Leigh Ann Retelsdorf
Attorney for Appellant: Jason E. Troia (Jason Troia Law)
Attorneys for Appellee: Michael T. Hilgers and Jacob M. Waggoner (Nebraska Attorney General’s Office)
Type of Action: Motion to Transfer to Juvenile Court
Action Taken by Trial Court: Jeremiah T. was charged in district court with one count of first degree sexual assault, a Class II felony. He was 15 years old at the time he allegedly sexually assaulted a 14-year-old female while on school grounds. Jeremiah filed a motion to transfer his case to the juvenile court. After a hearing, the district court found that a sound basis existed for retaining the case, and it denied Jeremiah’s motion to transfer to juvenile court.
Assignments of Error on Appeal: Jeremiah assigns that (1) the district court abused its discretion in denying the motion to transfer to juvenile court and (2) the State offered insufficient evidence to justify retention of the case in adult court.
