A-18-0112, State of Nebraska v. Jeffrey Loving (Appellant)
Douglas County, District Court Judge Gregory Schatz
Attorney for Appellant: Thomas C. Riley and Leslie E. Cavanaugh (Douglas County Public Defender’s Office)
Attorney for Appellee: Douglas J. Peterson and Nathan A. Liss (Attorney General’s Office)
Criminal Action: Second Degree Murder and Use of a Weapon to Commit a Felony
Action Taken by Trial Court: Appellant was found guilty of the charges by a jury. The district court subsequently sentenced him to a total of 110 to 130 years’ imprisonment.
Assignments of Error on Appeal: On appeal, Appellant alleges that the district court erred in (1) prohibiting him from testifying about his fears of retaliation while incarcerated and awaiting trial; (2) overruling his Batson challenge to the makeup of the jury; (3) erroneously instructing the jury regarding the elements of second degree murder and manslaughter; (4) failing to grant a directed verdict when there was insufficient evidence presented to demonstrate he did not act in self-defense; and (5) imposing an excessive sentence.
