A-17-061, State of Nebraska v. Michael W. McCurdy (Appellant)
Lancaster County, District Court Judge Darla Ideus
Attorney for Appellant: Robert Kortus (Nebraska Commission of Public Advocacy)
Attorney for Appellee: Douglas J. Peterson, Austin R. Relph (Attorney General’s Office)
Criminal Action: First Degree Sexual Assault of a Child (three separate counts), First Degree Sexual Assault, Intentional Child Abuse
Action Taken by Trial Court: A jury found Appellant guilty of all five charged offenses. The district court subsequently sentenced Appellant to a total of 95 to 115 years’ imprisonment.
Assignments of Error on Appeal: On appeal, Appellant alleges that the district court erred in making certain evidentiary rulings, in finding that his statement to law enforcement was knowingly and voluntarily given, and in denying his motion for a mistrial after the State committed misconduct during its closing argument. McCurdy also alleges that there was insufficient evidence to support his conviction for first degree sexual assault.
