A-22-0595, State v. Ottens (Appellant)
Lancaster County, District Court Judge Robert R. Otte
Attorney for Appellant: Abby Osborn (Shiffermiller Law Office, P.C., L.L.O.)
Attorney for Appellee: Michael T. Hilgers and Austin Relph (Attorney General’s Office)
Criminal: possession of cocaine, resisting arrest, and child abuse
Action Taken by the Trial Court: A jury convicted the Appellant of possession of cocaine, resisting arrest, and child abuse and the district court sentenced him thereon.
Assignments of Error on Appeal: Appellant contends that the district court contends that the trial court erred in: (1) denying his motion to suppress evidence obtained during a search incident to arrest and evidence obtained during a protective sweep of his hotel room; (2) denying his Franks motion regarding the validity of a search warrant; (3) failing to hold an evidentiary hearing on his motion for new trial and in denying his motion for a new trial; and (4) finding that there was sufficient evidence to submit the matter to a jury. He also contends that trial counsel was ineffective in 9 specific ways.
