Action Taken by Trial Court: Russell was convicted of criminal conspiracy to commit unlawful possession with intent to deliver a controlled substance. Following a direct appeal, Russell sought postconviction relief on the basis of ineffective assistance of counsel. The trial court denied Russell’s motion for postconviction relief without an evidentiary hearing.
Assignments of Error on Appeal: Russell claims the trial court erred in (1) receiving and relying on the pretrial orders from other court proceedings, and (2) failing to grant an evidentiary hearing, and failing to allow Russell to conduct discovery before such hearing.
