A-22-0918, State of Nebraska (Appellee) v. Timothy Temme (Appellant)
Lancaster County District Court, Judge Lori A. Maret
Attorney for Appellant: Matthew Kosmicki (Matt Kosmicki Law)
Attorney for Appellee: Marcee A. Brownlee (Assistance City Prosecutor – City of Lincoln)
Criminal: DUI; Motion to Suppress; Sufficiency of the Evidence
Action Taken by Trial Court: The county court overruled Appellant’s motion to suppress evidence and convicted him of DUI after a stipulated bench trial. Appellant appealed to the district court, which affirmed Appellant’s conviction and sentence.
Assignments of Error on Appeal: On appeal to this court, Appellant alleges that the district court erred by affirming the county court’s decision to overrule his motion to suppress evidence obtained as a result of the traffic stop. Specifically, Appellant asserts that the arresting officer lacked reasonable suspicion or probable cause to initiate the stop of his vehicle. Appellant also alleges that the district court erred by affirming the county court’s decision that there was sufficient evidence to prove Appellant guilty beyond a reasonable doubt.
