Proceedings Below: The trial court dismissed Michael Hall’s claims for lost profits and dismissed Alpha Wealth Advisors, LLC’s claims.  On appeal and on its own motion, the Nebraska Supreme Court ordered that this case be removed from the docket of the Nebraska Court of Appeals and transferred to its docket. 

Issues: On appeal, Appellants make the following assignments of error:  1) The Trial Court committed remandable error in granting Defendant’s motion for a directed verdict against Plaintiff Alpha Wealth Advisors, LLC, by concluding, as a matter of law, there was no evidence of damages; and 2) The Trial Court committed remandable error in granting Defendant’s motion for a directed verdict against Plaintiff Michael Hall by concluding Plaintiff Hall had failed to present evidence of lost income as a matter of law and by erroneously instructing the jury to disregard the testimony of Plaintiffs’ forensic economist.
