S-20-0737 Sonia Becher v. Mark A. Becher (Appellant)
Lancaster County District Court, Hon. Kevin R. McManaman
Attorneys: Adam E. Astley (Astley Putnam, PC, LLO, for Appellant); Sally A. Rasmussen (Mattson Rickets Law Firm, for Appellee)
Civil: Contempt
Proceedings Below: The district court found for the Appellee on her applications of contempt against the Appellant. The district court found that Appellant was in willful contempt for the non-payment of children’s medical bills, for non-payment of property taxes, for non-payment of the expenses of the “behavioral camp,” and that he owed Appellee attorney fees. The court denied all of Appellant’s defenses, sentenced him to 60 days in jail, and entered a purge plan in accordance with the findings.
Issues on Appeal: Whether the district court erred 1) when it found Appellant in contempt for failure to pay for the wilderness camp; 2) when it found Appellant in contempt for failure to pay a portion of the Appellee’s real property taxes; 3) when it found Appellant in contempt for failure to pay the children’s 2016 medical expenses; 4) when it did not give Appellant credit for the $886.05 that Appellant paid on account of the 2016 medical expenses; 5) in requiring Appellant to pay for the wilderness camp, property taxes, and 2016 children’s medical expenses as a part of his purge plan; 6) when it ordered Appellant to pay 100% of Appellee’s attorney fees; 7) in assessing prejudgment interest against Appellant; and 8) in requiring Appellant to timely pay all future children’s medical expenses that are properly presented as a part of his purge plan.
