Proceedings below: The district court dissolved the marriage and entered orders regarding valuation and award of marital assets and debts, custody and visitation of the minor children, child support, and alimony. Mark appealed and the Court of Appeals affirmed as modified. Becher v. Becher, 24 Neb. App. 726 (2017). Appellant Mark filed a Petition for Further Review which was granted by the Nebraska Supreme Court.

Issues on Review: 1. The Nebraska Court of Appeals erred in finding Mark had waived his right to appeal the award of three commercial properties to Sonia because he had quit claimed said properties to Sonia in compliance with the requirements of the Decree. 2. The Nebraska Court of Appeals also erred in adopting the Referee’s determination of custody and parenting time instead of remanding said issues to the district court to consider new admissible evidence pertaining to custody and parenting time which has developed while this case has been on appeal for the last twenty months and to properly consider the paramount concern which is the best interests of the children. 3. The Court of Appeals erred by not remanding this matter to the district court for further hearing so that a complete accounting may be conducted consistent with the Decree as now modified by the Court of Appeals decision.
