Case Summary

S-24-0487 Katherine Belcastro-Gonzalez (Appellant) v.  City of Omaha, a Municipal Corporation (Appellee)

Appeal from the District Court for Douglas County, Judge Kimberly Miller Pankonin

Attorneys:  Theodore R. Boecker, Jr. (Boecker Law, P.C., L.L.O. for Appellant) and Bernard J. in den Bosch (Deputy City of Omaha Attorney for Appellee)

Civil:  Petition to modify, alter, or vacate an arbitration award

Proceedings below: Appellant filed a petition to modify, alter, or vacate, in part, an arbitration award, and Appellee requested that the arbitration award be confirmed.  The district court denied Appellant’s petition and confirmed the arbitration award. On its own motion, the Court ordered that this case be transferred from the docket of the Court of Appeals to its docket.

Issues:  Appellant assigns the following errors:  1) The district court erred in failing to modify the arbitration award or to vacate the portion of the arbitration award as exceeding the arbitrator’s powers; 2) The district court erred in failing to find that the arbitrator exceeded his powers by ruling that the 100 day time limit to file a charge against Appellant was extended from the date of the arbitrator’s order; and 3) The district court erred in granting Appellee’s motion for confirmation of arbitration award to the extent that it affirmed that portion of the award that purported to grant the city an extension of time to file charges against Appellant from the arbitrator’s award.
