Issues: The district court erred in (1) denying Appellant’s motion for summary judgment by concluding that Appellees did not assume the parking lot lease, that the statute of frauds precluded the lease’s enforcement, and that equitable estoppel did not apply; and (2) granting appellees’ motions for summary judgment when a genuine issue of material fact existed regarding whether Appellees’ conduct evidenced an intent to assume the lease.
