Proceedings Below: Appellee filed a complaint to modify a court-ordered parenting plan, and Appellant filed an answer and counter complaint seeking modification. After a hearing, the district court found Appellant failed to show a material change in circumstances and denied his counter complaint. The court found Appellee’s work schedule affected parenting time and adopted Appellee’s proposed parenting plan to take into account her work schedule. On its own motion, the Nebraska Supreme Court ordered this case to be transferred from the docket of the Nebraska Court of Appeals to its docket.
Issues: Appellant assigns the following errors: 1) The district court erred when it found that the Appellant did not prove that there was a material change in circumstances; 2) The district court’s order granting the Appellee’s request to modify parenting time improperly delegates authority to the Appellee or the Appellee’s employment; and 3) The district court erred when granting the Appellee’s request for attorney’s fees.
