Proceedings below: The trial court denied Plaintiff's request to use the pseudonym 'Jane Doe' during the course of the case. Plaintiff appealed. The Court of Appeals dismissed the appeal under Neb. Ct. R. App. P. ' 2-107(A)(2) finding the order was not a final order pursuant to Neb. Rev. Stat. ' 25-1902 (Reissue 2008). Appellant filed a Petition for Further Review which was granted by the Nebraska Supreme Court.
Issues on Review: The Court of Appeals erred in summarily dismissing Appellant's appeal for lack of a final, appealable order. The Court of Appeals erred in overruling Appellant's motion for rehearing, finding the collateral order doctrine is inapplicable in these proceedings.
