Civil: Modification of custody and child support
Proceedings Below: The district court denied Appellee’s motion to modify custody, denied Appellant’s request to credit child support for the time the children were not with Appellee, and denied the parties’ requests for modification of child support. On its own motion, the Nebraska Supreme Court ordered this case to be transferred from the docket of the Nebraska Court of Appeals to its docket.
Issue: Appellant makes the following assignments of error: 1) The district court erred in holding there was no material change in circumstance; 2) The district court erred in approving an arbitrary child support order that does not follow the Child Support Guidelines; 3) The district Court erred in holding that only equitable estoppel would allow the district court to give Father credit for child support that he has paid to Mother when the children were not in her custody; 4) The district court erred in not adjusting the support payments retroactively to accurately reflect the juvenile case custody placements from the time of the complaint filings; and 5) The district court erred in approving the garnishment of Defendant’s bank account for an Order amount that is inaccurate and not due by him.
