Civil: Mediating a dissolution of marriage case

Proceedings below: As a part their dissolution of marriage proceedings, the parties participated in mediation, but they disagree whether they reached a settlement agreement.  Appellee moved the district court to enforce the settlement agreement, which was granted.  On its own motion, the Nebraska Supreme Court ordered this case to be transferred from the docket of the Nebraska Court of Appeals to its docket.

Issues: Appellant assigns the following errors:  1) The district court’s conclusion that the parties had reached a complete oral settlement agreement resolving all issues in the case is contrary to the law and the evidence; 2) The district court’s decision to impose the purported terms of the claimed oral settlement agreement upon Appellant is contrary to the law and the evidence; and 3) The district court prejudicially erred in refusing to address Appellant’s claim that, even if an oral settlement agreement had been reached, according to the terms Appellee claimed are in the agreement, it was void Under Neb. Rev. Stat. § 36-202(1).
