Case Summary

S-22-0840 John Edward Griffith, II and Christina M. Griffith (Appellants) v. LG Chem, Ltd., LG Chem America, Inc., Shoemaker’s Truck Station, Inc., d/b/a Shoemaker’s Shell Travel Center, and E-Titan, LLC (Appellees)

Appeal from District Court for Lancaster County, Judge Lori A. Maret

Attorneys:  Christopher P. Welsh (Welsh & Welsh, PC, LLC for Appellants), Mark A. Fahleson (Rembolt Ludtke, LLP, for Appellees LG Chem, Ltd. and LG Chem America, Inc.), and Matthew V. Rusch (Erickson Sederstrom, P.C., for Appellees Shoemaker’s Truck Station, Inc. and E-Titan, LLC)

Civil:   Conflict of Laws and Personal Jurisdiction

Proceedings below:  Appellant was injured in Pennsylvania after he purchased batteries that were manufactured by LG Chem, Ltd. and/or LG Chem America, Inc. from a vending machine owned by E-Titan, LLC and located inside a Shoemaker’s truck station in Nebraska.  The trial court granted summary judgment in favor of Appellees Shoemaker’s Truck Station, Inc. and E-Titan, LLC and dismissed Appellant’s case against LG Chem, Ltd. and/or LG Chem America for lack of personal jurisdiction.  On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.

Issues:  Appellant makes the following statement of errors:  1) The District Court erred in granting Defendants/Appellees Shoemaker and E-Titan’s motion for summary judgment; and 2) The District Court erred in determining that it did not have personal jurisdiction over Defendant/Appellee LG Chem America and granting Defendant/Appellee LG Chem America’s special appearance and motion to dismiss.
