S-24-0754 Megan E. Hawk (Appellant) v. David B. Hawk (Appellee)
Appeal from the District Court for Douglas County, Judge Tressa M. Alioth
Attorneys: John W. Ballew, Jr. (Ballew Hazen Byrd for Appellant) and Kathryn D. Putnam (Astley Putnam, P.C., L.L.O. for Appellee).
Civil: Dissolution of marriage, equalization payments, and order nunc pro tunc
Proceedings below: The district court entered an order nunc pro tunc clarifying that interest would begin accruing on the date when the first installment became due. On its own motion, the Court ordered that this case be transferred from the docket of the Court of Appeals to its docket.
Issues: Appellant assigns the following error: 1) The court erred in changing the commencement date of interest accrual on a final judgment in the context of a motion for order nunc pro tunc; and 2) The Douglas County District Court cannot vacate or modify its judgments after the end of term of court in which the judgment was rendered except as provided otherwise in Neb. Rev. Stat. § 25-2001(4).
