Proceedings Below: The trial court sustained Appellee’s Motion for Summary Judgment and dismissed Appellant’s Complaint. On appeal and on its own motion, the Nebraska Supreme Court ordered that this case be removed from the docket of the Nebraska Court of Appeals and transferred to its docket.
Issues: On appeal, Appellant makes the following assignments of error: 1) The district court erred in finding that language in the relevant Collective Bargaining Agreements bars and waives Appellant’s individual right to collect wages under the NWPCA; 2) The district court erred in finding that the Appellant’s failure to timely grieve the wage issue bars and waives his individual right to collect wages under the NWPCA; 3) The district court erred in sustaining and granting the District’s Motion for Summary Judgment; and 4) The district court erred in overruling and denying Appellant’s Motion for Summary Judgment.
