Case Summary

S-24-0700 Matthew M. Jaksha (Appellee) v.  Jessica E. Jaksha (Appellant)

Appeal from the District Court for Douglas County, Judge James M. Masteller

Attorneys: John A. Kinney (Kinney Mason, P.C., L.L.O for Appellant) and Matthew P. Saathoff and Jacob A. Acers (The Saathoff Law Group, PC, LLO for Appellee)

Civil: Order of modification

Proceedings below: After the district court entered an order modifying a decree of dissolution, Appellant sought to vacate or amend that order, which the district court denied.  On its own motion, the Court ordered that this case be transferred from the docket of the Court of Appeals to its docket.

Issues: Appellant assigns the following errors: 1) The trial court erred by failing to vacate its order of modification dated October 7, 2021; 2) The trial court erred in its determination that the order dated October 7, 2021, was a final order. The failure to allow Appellant to adduce evidence related to the pleadings leading up to said order or allow for mediation related to those pleadings is related to the decision on finality; and 3) The trial court erred in failing to make a determination that the order of modification dated October 7, 2021, violated Nebraska public policy and was void.
