S-23-396 Daniel Johnson (Appellee) v. Tina Vosberg (Appellant)
Appeal from the District Court for Douglas County, Judge Tressa M. Alioth, on appeal therefrom the County Court for Douglas County, Judge Grant A. Forsberg
Attorneys: Jason C. Hubbard (Jason Hubbard Law, PC, LLO for Appellee); Natalie M. Hein (Welch Law Firm, P.C. for Appellant)
Civil: Nebraska Uniform Residential Landlord and Tenant Act
Proceedings Below: The district court affirmed a county court order granting Appellee restitution of premises. On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.
Issues on appeal: Appellant makes the following assignments of error: 1) The county court erred as a matter of law by failing to consider evidence outside the four corners of the “Roommate Lease Agreement;” and 2) The county court’s factual finding that the “Roommate Lease Agreement” was the parties’ agreement was clearly erroneous and unsupported by the evidence.
