Proceedings Below: Lancaster County filed suit against Custer County seeking reimbursement for general assistance funds that Lancaster County provided to an alleged Custer County resident. Lancaster County filed a Motion for Summary Judgment, which was sustained by the trial court. On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.
Issues: Appellant makes the following arguments: 1) The trial court erred when it determined that it had subject matter jurisdiction pursuant to Neb. Rev. Stat. § 68-104 et seq. and that Neb. Rev. Stat. § 23-135 did not apply; and 2) The trial court erred when it granted Appellee’s Motion for Summary Judgment as a matter of law and concluded that no genuine issue of material fact existed.
