Proceedings below: The district court found that there had been a material change in circumstances not anticipated by the parties at the time of the June 2016 modification order. The change in incomes of both parties, and that Appellee had another minor child, were justification for a change in the Appellee’s child support obligation. However, the district court went on to find that no change could be made to the $645 downward deviation in child support and the court ordered Appellee to pay child support in the amount of $1,218 for two children, after application of the downward deviation of $645.
Issues on Appeal: Whether the trial court erred when it determined that the Appellee was still entitled to a downward deviation in his child support obligation to account for travel expenses incurred in order to exercise parenting time when the evidence showed that he was not incurring travel expenses.
