Case Summary

S-21-1030 Cheryl M. Mueller and Mue-Cow Farms, Inc.

Appeal from the District Court for Platte County, Judge Robert R. Steinke

Attorneys:  Clark J. Grant (Grant & Grant for Appellant); Neal J. Valorz (Sipple, Hansen, Emerson, Schumacher, Klutman, & Valorz for Appellee Margo Loop); and Burke C. Brown, III (Burke Brown Law for Appellee Gary Mueller).

Civil:  Enforcement of Settlement and Mutual Release Agreement

Proceedings below:  District court determined that settlement and mutual release agreement did not bar Appellee from pursuing a setoff against Cheryl Mueller’s distributive share of the Estate of Lorine Mueller.  On its own motion, the Nebraska Supreme Court ordered this case be removed from the docket of the Nebraska Court of Appeals and transferred to docket of the Nebraska Supreme Court.

Issues: On appeal, Appellant makes the following assignments of error:  1) The District Court erred in determining that the disposition of assets from the estate of Lorine Mueller is governed by Kansas law; 2) The District Court erred in determining the interpretation of the Settlement and Mutual Release Agreement must be determined by the Kansas probate court; and 3) The District Court erred in determining that the Settlement and Mutual Release Agreement does not bar Margo Loop or Gary Mueller from pursuing a setoff of the confessed judgment against Cheryl Mueller’s distributive share of Lorine Mueller’s estate.
