Civil: Landlord/Tenant and Restitution of Premises
Proceedings Below: The district court affirmed a decision from the county court which ordered restitution of premises to Appellee. Appellant petitioned to bypass the Court of Appeals, which the Supreme Court sustained and transferred this case to the docket of the Supreme Court.
Issues: On appeal, Appellant makes the following assignments of error: 1) The District Court erred by affirming the county court’s denial of Appellant’s request for a jury trial pursuant to Neb. Const. Art. I, § 6; 2) The District Court erred by affirming the county court’s issuance of the writ of restitution contrary to Neb. Rev. Stat. § 76-1447; and 3) The District Court erred by affirming the issuance of the writ of restitution without serving notice to the Appellant.
