Proceedings below: The district court entered judgment in favor of Appellee finding the contract rolled over for another year through the end of 2014 and further dismissed Appellant's counterclaim, equitable defenses, motion to dismiss, motion for judgment as a matter of law as well as other motions and defenses. Appellant filed a Petition to Bypass the Court of Appeals which was granted by the Nebraska Supreme Court.
Issues: The district court erred in (1) granting Appellee's complaint for declaratory relief; (2) denying Appellant's affirmative defenses of waiver, estoppel and other equitable defenses; and (3) denying Appellant's motion to dismiss its motion for judgment as a matter of law.
