S-24-0020 Matthew I. Ortega (Appellant) v. John Albin, Commissioner of the Nebraska Department of Labor, the Nebraska Department of Labor, and JPK & CMA Enterprises, Inc. d/b/a Island Towing (Appellees)
Appeal from the District Court for Hall County, Judge John H. Marsh
Attorneys: Mark T. Bestul (Legal Aid of Nebraska for Appellant) and Katie S. Thurber, Gerald W. Pankonin, Joel F. Green, Jacob H. Winters (Nebraska Department of Labor for Appellee)
Civil: Unemployment benefits
Proceedings Below: The Nebraska Department of Labor (NDL) denied Appellant’s application for unemployment benefits, which, on further appeal, was affirmed by both the NDL appeal tribunal and the district court. On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.
Issues on appeal: Appellant makes the following assignments of error: 1) The District Court of Hall County, Nebraska erred in affirming the Nebraska Appeal Tribunal decision that the Appellant voluntarily quit his employment without good cause; 2) The district court erred in requiring medical evidence to substantiate the Appellant’s work-related stress; and 3) The district court erred in determining the Appellant failed to preserve the employer employee relationship.
