Workers’ Compensation: Work-related injury

Proceedings below:  The Workers’ Compensation Court found that Appellee suffered an injury arising out of her employment and that she was entitled to benefits, including total temporary disability, partial permanent disability, and past and future medical care. On its own motion, the Nebraska Supreme Court ordered this case to be transferred from the docket of the Nebraska Court of Appeals to its docket.

Issues: Appellant makes the following assignments of error:  1) The trial court erred in finding Appellee suffered an injury to her respiratory system in an accident arising out of and in the course of her employment with Appellant; 2) The trial court erred in awarding temporary total disability benefits from July 19, 2020, through March 25, 2021; 3) The trial court erred in finding Appellee sustained a thirty percent (30%) loss of earning capacity; 4) The trial court erred in ordering Appellant to pay the medical bills found in Exhibits 40 through 44; and 5) The trial court erred in awarding future medical care to Appellee.

On cross-appeal, Appellee argues that:  1) The trial court’s award of total temporary disability from July 19, 2020, through March 25, 2021, was in error.
