Civil: Property Boundary Dispute
Proceedings below: Appellant sued to determine boundary lines between her property and Appellees’ property. The trial court entered a summary judgment establishing the boundary line between the parties’ properties as being located at the thread of the stream of the Middle Loup River. On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.
Issues: Appellant makes the following statement of errors: 1) The trial court erred when it sustained the motion for summary judgment of the Defendants-Appellees; 2) The trial court erred when it overruled the motion for summary judgment of the Plaintiff-Appellant; and 3) The trial court erred when it failed to recognize that the Government Land Survey required by law and was adopted by the United States before patents to Nebraska Lands were issued and are incorporated into the patents.
