Proceedings below: Following a jury trial, a verdict was entered in favor of Appellees. The Court of Appeals found the district court abused its discretion in excluding expert testimony and medical bills. Appellees filed a petition for further review which was granted by the Nebraska Supreme Court.
Issues on Review: The Nebraska Court of Appeals erred in finding the district court abused its discretion when it excluded from evidence portions of Dr. Vinton’s expert opinion testimony and a portion of Appellant’s medical bills, both of which were disclosed months after discovery had closed and after the district court had already granted three motions to continue.
