Case Summary

S-15-0610 Mark A. Putnum (Appellant) v. Keri G. Scherbring, Dale J. Scherbring and Janet Scherbring

Douglas County District Court, Judge Thomas J. Otepka

Attorneys: Herbert J. Hriedman (Friedman Law Offices, P.C., L.L.O.) (Appellant) & Paul Galter (Butler, Galter & O’Brien) --- Mark C. Laughlin & Jacqueline M. DeLuca (Fraser Stryker PC LLO) --- Cathy S. Trent-Vilim (Lamson, Dugan and Murray, LLP) (Nebraska Defense Counsel Association – Amicus Curiae)

Civil: Personal injury; evidence; discovery

Proceedings below: Following a jury trial, a verdict was entered in favor of Appellees.  The Court of Appeals found the district court abused its discretion in excluding expert testimony and medical bills.  Appellees filed a petition for further review which was granted by the Nebraska Supreme Court.

Issues on Review: The Nebraska Court of Appeals erred in finding the district court abused its discretion when it excluded from evidence portions of Dr. Vinton’s expert opinion testimony and a portion of Appellant’s medical bills, both of which were disclosed months after discovery had closed and after the district court had already granted three motions to continue.
