Proceedings below: The district court entered judgment for Appellants and overruled Appellants’ motion for new trial on the issue of damages.  The district court denied Appellee’s motion for partial summary judgment, his motion to reconsider, and his motion for settlement credit. 

Issues: The district court erred in 1) failing to grant Appellants’ motion for new trial on the issue of damages, and 2) granting Appellee’s motion for partial summary judgment and finding for Appellee as a matter of law on Appellants’ claim for damages for the initial insurance premium payments made directly to the insurance companies.

Issues on Cross-Appeal: The district court erred in 1) denying Appellee’s motion for partial summary judgment, his motion for reconsideration, and his motion for settlement credit, and 2) granting Appellants’ motion for partial summary judgment.
