Proceedings below: Appellant filed an objection to the probate of Decedent’s 2015 Will and 2015 Codicil. Appellees sought dismissal of Appellant’s objection, and the trial court dismissed the matter with prejudice. On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.
Issues: Appellants make the following assignments of error: 1) The District Court erred in dismissing the will contest with prejudice when there had been neither an adjudication of the testamentary instruments nor an approved compromise agreement, and 2) The District Court erred in denying Constance’s Motion for Leave to file an Objection.
