S-22-242 In the Estate of Filadelfo Scaletta, Deceased
Appeal from the County Court for Douglas County, Judge Jeffery L. Marcuzzo
Attorneys: David A. Domina (Domina Law Group for Appellant Carl Scaletta, Sr.) and Dennis P. Lee (Lee Law Office for Appellee Carl Scaletta, Jr.)
Probate: Contested Will and Jurisdiction
Proceedings below: Appellant filed a petition to set aside informal probate of will and objections to will, and the county court determined that it lacked jurisdiction to take further action due to the pending appeal of In re Estate of Filadelfo Scaletta, S-22-115. On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.
Issues: Appellant makes the following assignment of error: The county court erred by refusing to take sufficient action on Appellant’s Will Contest filings to set aside the informal probate and transfer the case to District Court for trial to a jury while retaining jurisdiction of administrative elements of the estate.
