S-17-1142 In re Guardianship of Lucas Joaquin
Douglas County Court, Judge Thomas K. Harmon
Attorneys: Roxana Cortes Reyes (Immigrant Legal Center/Justice For Our Neighbors Network) (Appellant) --- no brief filed by any Appellee/case in default
Civil: Guardianship
Proceedings below: The trial court appointed Appellant as guardian of the minor child but denied Appellant’s request to make certain findings of fact regarding the best interests of the minor child.
Issues: The trial court erred in (1) stating the only finding probate courts can make is to appoint a guardian if it is in the best interests of the minor; (2) denying Appellant’s request for findings of fact regarding the best interests of the minor including (a) reunification with the parents is not viable due to abuse/neglect/abandonment; (b) it would not be in the minor’s best interests to return to Guatemala.
