S-23-0340 and S-23-341 In re Name Change of Jegiso D. and Simon D., Carmen D. (Appellant) v. Garth D. (Appellee)
Appeal from the District Court for Burt County, Judge John E. Samson
Attorneys: John P. Farrell (Law Offices of John P. Farrell, LLC for Appellant) and Appellee is in Default
Civil: Change on Birth Certificate
Proceedings below: After the adoptive mother petitioned to change the names and dates of birth on the birth certificates for her adopted children, the district court approved the proposed name changes but determined it did not have jurisdiction to change their dates of birth on their birth certificates. On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.
Issues: Appellant makes the following assignments of error: 1) The court erred in finding that it did not have jurisdiction to correct the birth date of a Petitioner; and 2) The court erred in considering that it was not in the best interest of the child to change his birthdate.
