Case Summary

S-20-0209 Tyron A. Alli (Appellant) v. Patricia A. Seivert

Douglas County District Court, Hon. W. Russell Bowie

Attorneys: Kelly T. Shattuck (Vacanti Shattuck, for Appellant); Benjamin M. Belmont & Oliver Jenkins (Brodkey, Peebles, Belmont, & Line, LLP, for Appellee)

Civil: Putative spouse doctrine; Distribution of marital estate; Spousal support; Attorney’s fees

Proceedings Below: In January 2020, the district court ordered dissolution of a couple’s marriage, distributed the marital estate, and awarded child custody, spousal support, and attorney’s fees.

Issues: Whether the district court erred in 1) including in the marital estate Appellant’s property obtained  during the seven and one half years before divorce but after separation; 2) ordering Appellant to pay spousal support when Appellee worked part time and did not need the support; 3) ordering Appellant to pay $50,000 for Appellee’s attorney’s fees when she was capable of paying the fees on her own; 4) dividing the account that the couple had designated for tuition expenses and requiring Appellant to instead pay for all tuition at the children’s private school; 5) determining the value of Appellant’s new business solely by the redemption provision of the operating agreement when other jurisdictions use other methods to better determine actual value; and 6) failing to apply the putative marriage doctrine to find the parties legally married as of 1996 instead of 2012.
