Proceedings Below: After the district court issued a decree of dissolution of marriage, Appellant requested a new trial based on newly discovered evidence, which the court overruled. On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.
Issues on appeal: Appellant makes the following arguments on appeal: 1) The trial court erred in refusing to grant a new trial on the basis of newly discovered evidence; 2) The trial court erred as its findings are contrary to the evidence; and 3) The trial court erred in not adjusting its order to maintain joint custody after learning the Defendant no longer had military orders and a removal from the jurisdiction was no longer at issue and in the minor’s best interests.
