Proceedings Below: The trial court overruled Appellant’s Motion for Leave to file an Amended Complaint and sustained Appellee’s Motion for Summary Judgment. On appeal and on its own motion, the Nebraska Supreme Court ordered that this case be removed from the docket of the Nebraska Court of Appeals and transferred to its docket.
Issues: On appeal, Appellant makes the following assignments of error: 1) The trial court erred in granting summary judgment in favor of Concordia, as genuine disputes remain as to material facts and as to the ultimate inferences that the jury may draw from those facts with respect to Sinu’s negligence cause of action; and 2) The trial court erred in denying Appellants’ Motion for Leave to File Amended Complaint as the proposed amended complaint successfully states a claim for which relief could be granted.
