Proceedings below: After Respondent was convicted of filing a false tax return, the United States District Court for the District of Nebraska issued an Order revoking his license to practice law before it. The Counsel for Discipline has filed formal, disciplinary charges against Respondent and seeks to disbar him.
Issues: Respondent makes the following arguments: 1) Just as statutes relating to the same subject are in para materia and should be construed together, [Supreme Court] Rules should be read and construed together; 2 To automatically accept the judgment of the first state and impose the same discipline would constitute an abdication of the responsibility imposed on this Court to determine for itself, in proceedings conducted by it, or under its direction, the fitness of those permitted to practice in this State; and 3) The purpose of a disciplinary proceeding against an attorney is not so much to punish the attorney as it is to determine whether in the public interest an attorney should be permitted to practice.
