Proceedings below: The district court granted Appellees' motion for summary judgment and vacated the order of paternity and support previously entered. Appellant filed a Petition to Bypass the Court of Appeals which was granted by the Nebraska Supreme Court.
Issues: The district court erred in 1) granting summary judgment in favor of Appellee and vacating the order of paternity and support previously entered on or about May 29, 2009 as the state of law does not clearly entitle Appellee to relief, 2) finding that service of summons on Appellee was not proper under Neb. Rev. Stat. '' 43-1411 and 25-508.01, and 3) granting any relief to Appellee on the basis of equity as Appellee has an adequate remedy under the law at Neb. Rev. Stat. ' 43-1412.01.
