S-15-0180, State v. Abejide Abejide (appellant)
Lancaster County, Hon. Paul D. Merritt, Jr.
Attorneys: Douglas J. Peterson and Nathan A. Liss (Attorney General's Office); Joseph D. Nigro and Kristi Egger Brown (Public Defender's Office) (Appellant)
Criminal: first degree sexual assault; terroristic threats
Proceedings below: After a jury trial, Abejide Abejide was convicted of attempted first degree sexual assault and terroristic threats. After an enhancement hearing, Abejide was found to be a habitual criminal. He was sentenced to 10 to 20 years' imprisonment for the attempted sexual assault and 10 to 10 years' imprisonment for the terroristic threats, and the sentences were to run consecutively. Abejide appeals.
Issue: Abejide assigns that the district court erred when it (1) rejected his proposed jury instructions, (2) entered guilty verdicts that were unsupported by admissible evidence, (3) imposed an excessive sentence. As his fourth assignment of error, Abejide assigns that he received ineffective assistance of trial counsel.
