S-21-0457 State of Nebraska v. Komla Abligo (Appellant)
Appeal from District Court for Douglas County, Judge James M. Masteller
Attorneys: Tamara T. Mosby and Korey T. Taylor (Douglas County Public Defender’s Office for Appellant) and Austin Relph (Attorney General’s Office for Appellee)
Criminal: First Degree Sexual Assault, Class II Felony.
Proceedings below: After a jury trial, Appellant was found guilty of First Degree Sexual Assault, a Class II Felony, and he was sentenced to four (4) to ten (10) years in prison.
Issues: Appellant asserts that the district court 1) abused its discretion by finding snapchat videos of A.A.'s behavior were inadmissible; 2) abused its discretion by denying Abligo's motion to continue; 3) abused its discretion in admitting the text messages purportedly between Abligo and A.A. as the State failed to properly authenticate the messages and the messages included inadmissible hearsay; 4) abused its discretion in admitting the sexual assault nurse examiner’s testimony and medical report because they were inadmissible hearsay; and 5) abused its discretion by imposing an excessive sentence upon Abligo.
