Proceedings Below: The Nebraska Court of Appeals affirmed Appellant’s convictions for first-degree sexual assault of a child and third-degree sexual assault of a child. Appellant filed a petition for further review, which the Nebraska Supreme Court sustained and transferred this case from the docket of the Court of Appeals to its docket.
Issues: On petition for further review, Appellant makes the following statement of errors: 1) The Court of Appeals erred in finding that Appellant had failed to preserve error relating to the trial court’s ruling that quashed the subpoena of Dr. Partida and barred admission of the documentation in Exhibits 1 & 2; and 2) The Court of Appeals erred in finding that Appellant’s assignments of error regarding trial counsel’s ineffective assistance regarding Dr. Partida evidence was both too finely tailored and insufficiently broad to be effective.
