Proceedings below: Following a jury trial, Appellant was convicted and sentenced to life to life for both counts of 1st degree murder, 30 to 40 years imprisonment for both counts of attempted 1st degree murder, and 25 to 30 years imprisonment for all four counts of use of a firearm, all to run consecutively.
Issues: The district court erred in 1) overruling Appellant’s motion to suppress, 2) admitting evidence derived from the unlawfully seized firearm because it was the fruit of the poison tree, and 3) admitting evidence of a jail phone call over Appellant’s hearsay and 27-403 objections.
