S-20-0148 State of Nebraska (Appellee) v. Marc J. Bartel (Appellant)
Douglas County District Court, Hon. Marlon A. Polk
Attorneys: Nathan A. Liss (Nebraska Attorney General’s Office, for Appellee); Michael J. Wilson (Berry Law Firm, for Appellant)
Civil: Motion for a new trial; Domestic abuse protection order
Proceedings Below: A jury found the Appellant guilty of violating a domestic abuse protection order. Appellant filed a motion for a new trial in the county court based on a district court’s order in his separate domestic case that purported to render the original protection order void ab initio. The county court denied Appellant’s motion, and the district court affirmed. Bartel appeals.
Issues: Whether the district court erred in affirming the county court’s denial of Appellant’s motion for a new trial because the district court’s order, which purported to render the original protection order void ab initio, 1) was newly discovered evidence material to Appellant’s defense; 2) proved an irregularity in the prosecution’s primary witness akin to fraud, thus preventing Appellant from receiving a fair trial; and 3) rendered Appellant’s conviction contrary to law and without sufficient evidentiary support.
