Case Summary

S-19-0300 State of Nebraska v. Maurice Briggs (Appellant)

Douglas County District Court, Judge Peter C. Bataillon

Attorneys:  Austin N. Relph (Office of the Attorney General, for Appellee) – Bethany R. Stensrud (Douglas County Public Defender’s Office, for Appellant)

Criminal: Possession of a controlled substance; Motion to suppress

Proceedings below: On June 21, 2018, the trial court heard the Appellant’s motion to suppress. After hearing evidence and argument, on October 24, 2018, the trial court denied the motion to suppress. Following a stipulated bench trial in which the Appellant preserved his objection to the denial of his motion to suppress, on December 17, 2018, the trial court convicted the Appellant of two counts of possession of a controlled substance. On February 25, 2019, the trial court sentenced the Appellant to a term of probation for a period of 30 months for each offense and ordered the terms of probation to run consecutive to one another.

Issues:  Whether the trial court erred in denying Appellant’s motion to suppress.
