S-20-0551 State of Nebraska v. Anthony L. Burries (Appellant)
Douglas County District Court, Hon. J. Russell Derr
Attorneys: Beau Finley (Law Offices of Beau Finley, PC LLO, for Appellant); Nathan A. Liss (Office of the Attorney General, for Appellee)
Criminal: Postconviction; Default judgment
Proceedings below: Following a jury trial, the Appellant was found guilty of one count of first-degree murder. The Appellant was sentenced to a term of life imprisonment and was given credit for 503 days previously served. On July 22, 2020, the district court entered an order denying the Appellant’s second amended motion for postconviction relief.
Issues on appeal: Whether the district court erred 1) in failing to grant the Appellant’s motion for default judgment; 2) in failing to grant the Appellant the opportunity to be heard regarding his motion for default judgment; and 3) by entering an order on July 22, 2020 denying the Appellant’s request for postconviction relief.
