Proceedings below: Following a jury trial, Appellant was found guilty of four counts of sexual assault of a child and sentenced to 1 to 3 years for count I and 35-40 years for counts II, III & IV.
Issues: The district court erred in 1) admitting evidence of other bad acts/uncharged conduct in violation of Neb. Rev. Stat. ' 27-404(2), 2) advising the jury that the exact time of the commission of the offense alleged in Count I was not an essential element of the offenses of the third degree assault, and 3) convicting Appellant based on insufficient evidence.
